this ongoing internet defamation dispute could get confusing due to its encompassing two separate civil cases involving outspoken alexandria, la. attorney thomas d. davenport, jr., and la dads.info webmaster daniel slayter.

mr. davenport filed his suit against mr. slayter around 22 august 2011. it has never been served.

then around 06 september mr. slayter filed his own petition against mr. davenport and timely served it.

in the slayter vs davenport suit, mr. davenport is represented by marshall r. pearce of the powerful shreveport, louisiana casten & pearce law firm.

what makes these subpoenas so interesting is that they were applied for by mr. davenport's secretaries through the davenport vs slayter suit which has never been served on the prospective defendant.

an answer in the slayter vs davenport suit is due any day now; we're sure that will be an interesting read plus there is already an entry of recusal by the regular alexandria city court judge, richard starling so everything is in limbo! boo

the other day cenlabriarpatch.com posted the gmail they received from google which began ... "google has received a subpoena for information related to your google account," to turn over all the info they have on mailthepatch@gmail.com ...

the gmail apparently originated due to the 26 september 2011 application made by thomas davenport's secretary, brittany kier, to command google inc to produce:

"ip address," account information, registrant's name,address, telephone, user identification, user account name, digital footprint, internet protocol address, email header, originating ip accounts, host name, ip decimal and any information related to and that would identify user profiles/accounts concerning "mailthepatch@gmail.com" to the davenport firm, 1628 metro drive, alexandria, louisiana 71301, within five (5) days of receipt of subpoena duces tecum service.

also on the same day, mr. davenport's other secretary, tewanna sarpy, made application to the clerk for another subpoena duces tecum this one served on domains by proxy about their info for, cenlabriarpatch.com:

[T]he account information, registrant's name, address, telephone, name listed on method of payment, user identification, user account name, digital footprint, internet protocol address, originating ip accounts, host name, ip decimal and any information related to and that would identify user profiles/accounts, and owner of the domain "cenlabriarpatch.com" to the davenport firm ... within five (5) days of receipt of subpoena duces tecum service.

around noon yesterday the alexandria city court clerk faxed what should be the true copies of the applications and subpoenas duces tecum. they are in the case the davenport firm l.l.c. and thomas d. davenport, jr., versus daniel ray slater a/k/a danny slayter | civil docket number 120116.

this move struck us as odd because this suit was filed ages ago [around 22 august 2011 actually] and the clerk's office has no record of it ever being served on the defendant. there is a letter in the suit file (we meant to get - try again on monday) from the plaintiff to the court requesting to withold service.

yet subpoena applications are being made and issued, in that;

the first post on the cenlabriarpatch blog was posted on 16 september 2011 "the story of a little klansman."

and 10 days later the davenport firm is applying for subpoenas yet the suit was filed weeks earlier and the defendant was never served. "please serve daniel ray slayter, a.k.a. danny slayter, 2828 jackson street, alexandria, louisiana 71301," the petition reads at page 6.

this is only a few blocks from the city courthouse. so what gives?

it will be interesting to see if there will be any any responsive pleadings or contradictory hearings.

anyway, there's a lot more that could be and probably will be written. so ... stay tuned.

controversial alexandria, la., attorney thomas d. "tommy" davenport, jr., sued ... again

according to cenlabriarpatch.com this is the third defamation suit recently filed against mr. davenport.

this morning on the "talk back am 970 with fred and bob" radio program, co-host fred rosenfeld anointed mr. davenport to be the blogosphere replacement for the recently expired local shyster and toxic "blogger" greg aymond. with all this going on we'd have to agree that he would appear be the perfect aymond replacement. click here to download .mp3 audio file [2.50 mb].

this petition for damages is filed -- self-represented, by a local guy named michael hoover, who, according to the petition, is a private portfolio manager and tulane law school graduate, claims that he was damaged by mr. davenport's allegedly spreading false rumors about his character and integrity.

according to the petition mr. hoover says that he privately manages funds running into the hundreds of millions of dollars so as you can imagine he cant have that.

this suit is allotted to ninth judicial district court judge john c. davidson.

gannett/the town talk seeks to protect "thecleartruth" anonymous commenter alleged to be controversial alexandria la attorney thomas davenport

in the latest installment of the davenport vs slayter and slayter vs davenport internet defamation litigation -- two extremely contentious lawsuits which have generated massive public interest -- gannett/the alexandria daily town talk a/k/a alexandria newspapers, inc., recently -- through their attorney, andrew p. texada, of the alexandria, la., stafford, stewart & potter law firm, filed a motion and accompanying memorandum for a protective order and to quash a subpoena mr. slayter had served on them for the production of, amongst other things, account information of several past town talk anonymous commenters including:

"thecleartruth;" "thecrazyone2011;" "bigmouth2010;" "speakupnow;" "triplefun4me" and "damnshame123."

we suppose that gannett and the town talk really have no choice but to fight the subpoena -- what with all the fallout gannett received a couple of years ago over their wausau daily herald screw-up.

in any event, the town talk recently switched over to requiring their commenters to log in to and comment through their facebook account.

as we understand it, mr. davenport has maintained all along that he is not one or any of the above anonymous commenters. however, it must be noted that he sure has waged a hard fought and expensive legal battle to keep that information from being released. hmmmmm.

city of alexandria, la. trying to stiff abandoned car ordinance attorney his legal fees

yesterday in the public safety zoning committee, chairman roosevelt johnson heard an update on "abandoned vehicles." in january 2007 the alexandria city council unanimously passed and the alexandria mayor signed, a so called abandoned car ordinance. the ordinance was so seriously flawed constitutionally that your average citizen could see it. besides being constitutionally flawed the ordinance was predatory and racist. the ordinance actually empowered city bureaucrats to come onto private property, tag and order removed privately owned automobiles. we're not talking cars parked on the side of the street but cars stored under sheds, garages and in one case, reported by the media, from an elderly alexandriaian's back-yard.

sure enough, the city towed one man named errick fatheree car which was stored "in an enclosed garage/shed upon private property."

a courageous local attorney, thomas d. davenport, jr., took mr. fatheree's case pro bono and won.

which brings us up to yesterday and city attorney johnson's statement to chairman johnson that one "sticky issue" remains and that is a "dispute over the fee that the attorney is seeking." it dont matter if mr. davenport's fee is one hundred or a hundred thousand or a million dollars, the city should pay whatever hes asking and be glad that no one was shot during the enforcement phase of this disastrous ordinance. mr. davenport provided a good and valuable service to the citizenry and more importantly to the constitution when seven members of the city council and the mayor who all should have known better passed this garbage.

the alexandria mayor is a lawyer and as the gannett/town talk editors pointed out in their sunday 20 april 2008 editorial [screen grab] how mayoral candidate roy sounded "jeffersonian." actually the mayor quoted jefferson quite often during the campaign. then on 22 december 2006 only eighteen days after he took office, this ordinance which is about as anti-jeffersonian as you can get, was introduced and which he eventually signed.

now the mayor and his city attorney want to stiff an attorney who reminded them about constitutional and jeffersonian principals? the city should pay mr. davenport whatever he is asking and be glad they got off so cheap.

something ominous that we can see in store is that councilman johnson was wanting to know when this suit will be finished so that the city council can revisit abandoned cars and another abandoned car ordinance. they never learn.

third circuit posts opinion in tiffany n sanders vs alexandria civil service commission feat alexandria mayor jacques roy

The Mayor and the City now appeal, asserting that the trial court erred: in dismissing their petition of intervention on its own motion; in rendering orders and decrees beyond any relief sought by the parties; and in asserting jurisdiction over and issuing rulings in a case not assigned to it and in "which case the court's Consolidation Order had been rendered moot by a specific Writ Application Ruling of this Court."

on 05 october 2011 the 3rd circuit appeals court heard the oral argument of the consolodated appeal from a judgment signed by ninth judicial district court judge george metoyer.

this case is seen as a "must win" for the mayor.

there has been lots of speculation in the form of internet chatter, for example, on gannett/the town talk's forums; in their news coverage of the court proceedings, of unethical attorney conduct, as well as possible judicial misconduct and even possibly collusion on the part of the judge and one of ms. sander's attorneys, namely, thomas davenport. it looks like a lot of that was spelled out in the mayor's other assignments of error.

sadly, the 3rd circuit by refusing to address those important issues engaged in another louisiana style good ol boy network coverup, perhaps a little judicial asscovering, -- choosing to rule only on the mayor's first assignment of error.

of course if the corrupt, crooked louisiana judicial branch of government didnt hide their proceedings from view by prohibiting citizens from bringing their own cameras and recording devices in the courtroom (all courtrooms should be streamed online anyway and if the court proceedings were streamed online it would help put a stop to a lot of the outright fraud that goes on) we could look at the courtroom video and see for ourselves.

alexandria 'abandoned' car ordinance challenged!

back on 25 january 2007 we were a little aghast, to put it lightly, when we read in our daily paper about the alexandria, louisiana mayor and the alexandria city council's action in ordaining the new so called abandoned car ordinance. the mayor and city council in a colossal slap to the united states constitution generally and the fourteenth amendment specifically in one fell swoop voided some alexandrian's constitutionally guaranteed right to due process.

just like we pointed out back then, this ordinance is directed solely at alexandria's black residents. the town talk reports in a story here that "according to the Alexandria Public Works Department, which oversees code enforcement, the division has towed 94 vehicles since the ordinance went into effect. " now how many of those vehicles were towed from the black neighborhoods? we bet most if not all were.



as we have written before like here anytime you see a new law or ordinance enacted the first thing you should ask yourself is "who benefits?" a check of the jacques m. roy campaign finance reports here does not reveal a jerry tyler as either a contributor or in the expenditures but we do find a chris tyler (jerry tylers son?) who appears to be a major roy campaign contributor. pay back? its very plain to see whats going on here -- they are stealing these peoples cars then tacking on outrageous towing and storage fees that they know the people cant pay. then when the legal time elapses they are selling the cars to their auto parts/junkyard buddies. this is a racket its a huge scam.


thomas davenport comment on the town talk forum "resident suing city over abandoned vehicle rule."

alexandria mayor jacques roy sets up a soviet style "administrative hearing panel" commonly called a "kangaroo court" compromised of no elected officials, in fact, the membership is limited to city of alexandria employees.

during the alexandria mayoral campaign candidate jacques roy quoted both thomas jefferson and from the federalist papers freely and extensively then when he gets in office invokes policies more inline with stalinist russia or castro's cuba.

its been reported that the mayor and the city council are in the process of formulating a new ordinance regarding abandoned buildings. this is particularly disturbing when you see how this crew likes to play fast and loose with word meanings and definitions:

abandon
v. to intentionally and permanently give up, surrender, leave, desert or relinquish all interest or ownership in property, a home or other premises, a right of way, and even a spouse, family, or children. The word is often used in situations to determine whether a tenant has left his/her apartment and the property inside and does not intend to come back.

mayor roy and the alexandria city council definition of "abandoned"

Any motor vehicle which does not have lawfully affixed thereto, both an unexpired license plate or plates and a valid motor vehicle safety inspection certificate is an abandoned vehicle. - alexandria city ordinance 13-22.

so if one was to follow this line of thinking -- whats to stop the mayor and the city council to say that for instance you havent painted your structure or shingled your roof in the past several years so you have abandoned your house or office building etc etc.

next up with this abandoned vehicle odorince should be a class action lawsuit against the city and wouldnt it be terribly ironic if the punitive damages equaled about what the city should be due back with regards to the cleco settlement?

third circuit: jonathan goins may run against charles fredrick smith for alexandria city council district three seat...

heroic local attorney, thomas d. davenport, jr., the attorney who had the city of alexandria, louisiana racist and predatory 'abandoned car' ordinance thrown out -- does it again!

court records reveal that charles fredrick smith and his lawyers george gaiennie, iii and eugene p. cicardo, jr. had weak witnesses and even relied on a convicted felon who didnt know what he was talking about:

"The other witness, "Spanky" Garmon, was revealed to be a convicted felon, who was not known as a resident of the community by the defendant and his witnesses. His testimony revealed that he erroneously described the location of the home on Juliet Street and could not identify Goins' vehicle."

The facts established at trial in this case, as well, reasonably support the trial court’s finding that Goins’ “actually resided” within District 3 at the Juliet Street home. In summary, Goins was raised at the Juliet Street address and after completing law school in 2006, returned there to reside exclusively until approximately May of 2007 when he began leasing an apartment outside of the district. Nevertheless, Goins continued to maintain the Juliet Street address on his drivers’ license and receive his mail at that address.

The record reasonably establishes that although Goins did not continue to exclusively sleep overnight, eat, maintain all of his clothing, or entertain at the Juliet Street home, he has maintained "significant connections to the [JulietStreet] address, [signifying] that his residency is real rather than fictitious." Russell, 780 So.2d at 1052.

We, accordingly, find no manifest error in the trial courts finding "[t]hat he has maintained a commitment to the neighborhood and continues to do so in a manner, and uses the property in a way, that meets the meaning of 'actually resides.'"


The judgment of the trial court is affirmed. Costs of this appeal are assessed to plaintiff-appellant, Charles F. Smith, Jr.

anyone who reads mayor jacques roy "motion to set aside and vacate order of consolidation and grant motion for voluntary dismissal," will understand that our calling the so called tiffany n sanders' "'unopposed' motion and order to consolidate," a false pleading is neither hyperbolic or reckless. after all, mayor roy flat-out stated that it was "contrary to law," .pdf pg 6 para. 6.

according to the online legal dictionary, "contrary to law" is defined as:

contrary to law adjective criminal, false, illegal, illegitimate, improper, inaccurate, incorrect, inexact, lawless, malfeasant, outlawed, proscribed, tortious, unauthorized, unlawful, wrong.

further, the mayor charges that ms. sanders' motion and order were in violation of several of the uniform rules for district courts.

many of the gannett/town talk commenters will remember the tiffany sanders "unopposed motion for consolidation," as that maneuver reportedly by mr. davenport when he went to see judge metoyer at a local restaurant and got him to sign the motion order. mayor roy mentions that in his papers too: .pdf pg 7 para. 7.

so the question is, why did the 3rd circuit sweep it under the rug? especially when it is an important public issue (the integrity of our courts) and when it was clearly marked for review in the mayor's assignments of error? where is the investigation? where is the accountability?

we cant have lawyers filing fictitious pleadings and judges signing improper orders and trying to pass it off as legitimate. that is called a scam. if they do it in a high profile case like this ... imagine what goes on everyday.

suppose a lawyer and a judge were in cahoots and the lawyer brought the judge something to sign without telling you about it and so you got an order and a judgment against you. how would you like that?

we think that sheriff wagner would have been much more successful, if instead of reciting -- at every opportunity, his "drug war" nonsense would have focused on investigating public corruption and white-collar criminals ... taking down the political and governmental organized crime gangs.

so once again where are the feds? to do the locals job for them ... again. time will tell.

this would seem to run counter to what our own third circuit court of appeal said just a few months ago in a public records suit styled richard j. heath vs city of alexandria, louisiana in which they wrote that aymond acting as counsel to heath:

"makes a blanket assertion that La.Const. art. 12, § (C) would render the Public Records Law useless, while providing no legal support for his assertion and ignoring the clear pronouncements of the supreme court on the issue of the enforcement of judgments against the State and its subdivisions.

The admitted “frustrating dichotomy” created by La.Const. art. 12, § 10(C) renders the Louisiana Public Records Law no more useless than it renders tort or contract suits against the State, and the trial court was correct in applying La.Const. art. 12, § 10(C) in this case, in accordance with Newman. as far as aymond's (self-proclaimed) assertion that he is one of louisiana's leading attorneys in the area of contract law -- well his experience with the video file sharing site vimeo.com once again seems to disprove the truthfulness of his statements.

aymond who had an account with vimeo (user3269590 to be exact), apparently, either didnt bother to read his account contract with them, couldnt comprehend it, chose to ignore it or a combination.

vimeo's uploading guidelines specifically state among other things, that:

its easy to see that what aymond was doing here was -- instead of creating his own videos of alexandria city council meetings by actually attending meetings and video taping them himself -- he was recording them from off his tee-vee and apparently misrepresenting them to vimeo to be his own creations -- until, it looks like, vimeo finally caught on to his game.

aymond was also routinely recording clips from kalb-tv and at least once from katc-tv and uploading them to vimeo and that was prohibited in his contract with them as well.
all of this led to an account deletion for one of louisiana's own (self-proclaimed) leading attorneys in the area of contract law.

jonathan goins resigns from the alexandria, la. city council

by now everyone who follows local politics knows about alexandria, la., city councilman jonathan goins' sudden and unexpected resignation from the council.

it's too bad that mr. goins resigned his position especially in light of his hard fought court win against the lame attempt by the then district three incumbent charles fredrick "droopy draws" smith to have him disqualified.

"droopy draws" smith lost his "petition to disqualify candidate" at both the trial court and third circuit appeal court levels and mr. goins went on to defeat him (as well as the roy machine) at the ballot box by a 2 -1 margin.

as is often the case when a controversy involves a louisiana career tax feeder, mayor roy reincarnated "droopy draws" to head his safealex secret police stasi snitch program -- who knows it might have been some information gleaned on mr. goins through that which led to his resignation.

charles frederick smith was represented by roy sock puppet, george gaiennie, iii and mr. goins by controversial alexandria attorney, thomas d. davenport, jr.

the trial court judge was now retired ninth judicial district court judge, florence ray swent.

klax new news broadcast

mmmkay. first thing they need to do is turn down the color cos it looks like tammy faye bakker or kathleen harris collided with our tv screen. then come to find out via a story here or here that not only are the anchors not from around here they arent even in louisiana! they are in davenport, iowa at kljb. so all klax has is a camera man or two running around filming footage and its being produced and broadcast 715 miles [1151km] away by some fox affiliate. oh fox thats strike one well actually as far as we're concerned its actually all three strikes because anything rupert murdoch and news corporation has their fingers in (pardon our french...not really) is total bullshit.

one of those town talk stories mentions "news will be integrated with Independent News Network, a news outsourcing service..." so we meandered over to their website www.inn-news.net and were pretty shocked that for a corporate website its pretty amateurishly done and very ambiguous. ambiguous in that they dont really give any information corporate or otherwise. naturally, this piqued our curiosity so we had to go over to the iowa secretary of state / corporations division website and do some searching. we found out that the town talk wasnt exactly um, accurate...shock! [feign mock surprise!]...oh there was a company called independent news network, inc., up till 31 december 2003. on 24 november 2003 the shareholders voted to change inn's name and that effective on the 1st of january 2004 the new name would be regional news company. list of officers here.

it looks like what this company does is produce "local newscasts" so at 6:00 pm they pretend to be in alexandria doing our local news then at 6:30 they turn around and pretend to be oh say podunk, idaho's local news cast and on and on.

in klax's defense back in the 90's they did have a kick-ass news department made up of local reporters and anchors. the thing is, is that people around here were (are) brainwashed and wont watch anything else but kalb -- they feel like they are missing something if they dont. thats the same reason they read the town talk. so when the locals find out the people arent even physically here...well we give this venture about six months tops.

kalb is having technical difficulties

so, at 9:59 p.m. friday night we switched over to kalb channel 5, to watch the 5th quarter show only to be greeted with the below picture on the screen:

out of curiosity we flipped over to kalb's sister station cbs 2 - this is what was on their channel.

for the hell of it, we checked to see if mercury is in retrograde -- its not. we doubted that mercury had anything to do with it, because at kalb's 6:00 p.m. news cast, for about the first 2 minutes they reran the first two minutes of the nbc nightly news which they had just broadcast at 5:30 - the same thing happened on kalb about a month or so ago.

the rachael ray picture stayed on kalb until 10:20 p.m. when the screen went blank. kalb finally came back on the air at 10:58 p.m. when they joined in progress the tonight show with jay leno.

in the meantime, we switched over to klax to see what they had to offer for sports reporting. their broadcast originates out of davenport, iowa -- thats right the news anchors you see arent even in alexandria. they didnt have any footage from any game whatsoever -- all they had was some sports scores:

alexandria, louisiana's klax-tv broadcast a package of stories recapping hurricane ike and its rampage across texas, louisiana and the united states. originally broadcast 10:00 p.m. cdt sunday 14 september 2008.

starting at galveston, texas the buildings on seawall blvd. have been reduced to rubble.

in louisiana thousands were affected by hurricane ike's storm surge.
